A class action lawsuit has been filed against the Government of Saskatchewan and the Public Guardian and Trustee of Saskatchewan. It’s on behalf of all children who were in custody and guardianship of the Minister Responsible for The Child Welfare Act, The Family Services Act, or The Child and Family Services Act between January 1st, 1959 and November 14th, 2017, and who suffered in that time, a personal injury as a result of a crime or tort committed by a third party and for whom the government did not make a claim under any of several appropriate acts. Compensation is also sought if the government failed to commence a civil action to obtain compensation on their behalf, or hired a lawyer to represent their interests. The Foster Care Class Action is being handled by the Merchant Law Group in Regina. For those who wish to, it is possible to opt out of the lawsuit.
