Unifor Local 594 has been fined $250-thousand for contempt of court.
Court of Queen’s Bench Justice Neil Robertson concluded that a December injunction where delays were not to be more than 10 minutes going in or going out were not obeyed.
That means Federated Co-op can remove the barricades and if the breaches against the injunction continue, FCL can come back to court with 3 days notice.
Robertson says in his decision that there was no doubt the injunction was being violated but the question is whether the named respondents are guilty and what sanctions should be imposed.
Federated Co-op had also requested that Unifor Local 594 President Kevin Bittman and Vice-President Lance Holowachuk be charged with contempt of court for failing to comply with the injunction.
Bittman was found not guilty and Holowachuk was given 40 hours of community service.
Half of the fine is to go to the Street Culture project and the other half goes to the government because of police resources deployed during this labour dispute.
