The Supreme Court of Canada says it will hear Saskatchewan’s appeal of the carbon tax, and Ontario’s appeal of the same, in September. The two cases were supposed to have been heard last March and then were postponed, tentatively rescheduled for some time in June. No specific dates in September have been announced. In May of 2019, The Saskatchewan Court of Appeal ruled that the carbon tax is constitutional. It was a 3-2 split decision. Then in June last year, the Ontario Court of Appeal also upheld the constitutionality of the federal penalty. But then in February this year, the two provinces were emboldened by the Alberta Court of Appeal that ruled in a 4 to 1 decision that the tax is unconstitutional.
