Carry the Kettle First Nation is reaffirming their right to self-governance after their custom election law was deemed unjust in court. In 2017, CTKFN approved its own custom election law called the Cega Kin Nakoda Oyate Custom Election Act. This act prevented the Indian act and the Government of Canada from having jurisdiction over their election practices.
In 2022, two band Council members were removed from their positions in compliance with the custom Act, and a by-election was called to elect two new band Councillors. According to a news release, the two removed Councillors took the matter to court to be reviewed. The federal court ruled in favour of the two former Councillors, and stated that the CTKFN Chief did not have the right to remove them from the band. Chief Scott Eashappie of the Carry the Kettle Nakoda Nation says this ruling went against the Nation’s rights to self-governance and says their treaties with the British Crown must be respected, as they are older than the provincial justice system.
