Clare’s Law officially goes into effect a week from today. It is the Interpersonal Violence Disclosure Protocol that allows police to disclose information which could help protect potential victims of interpersonal violence.
Once the legislation is binding on June 29th Saskatchewan residents can make an application to their local municipal police station for the release of information on an intimate partner’s past violent or abusive behavior.
The reason municipal police station is specified is because the Minister of Justice has released a letter where he says the RCMP indicates it is now refusing to participate in Clare’s Law.
Don Morgan indicates that the RCMP referenced an undisclosed legal opinion and he also says that the provincial government had been willing to meet with any legal counsel the RCMP may be using. The Justice Minister says they can outline why Clare’s Law is in compliance with any applicable legal requirements including privacy legislation.
