The Saskatchewan Court of Appeal has upheld a verdict in the “grain sale/emoji” case.

In March 2021, a grain buyer with South West Terminal sent a text to a farmer for a delivery of flax. The farmer responded with a “thumbs-up” emoji, but no text.

The buyer considered that to be a sales confirmation while the farmer maintained it was only confirmation that the text had been received.

Later when the farmer did not deliver the flax, the company took him to court for breaching the contract.

A Court of King’s Bench judge ruled the emoji served as a proper confirmation. The farmer was ordered to pay more than 82-thousand dollars, plus interest and court costs.
